Introduction
This full day in-person course is aimed at those who deal with residential conveyancing but who want to deal with commercial/real estate matters.
It deals with all the aspects of a freehold sale or purchase of a commercial property, highlighting the differences between residential and commercial transactions. It will be very practical looking at the types of documents you will need to use and tips for their use. We will look at each stage of the process in detail and flag up the issues that are likely to arise on a freehold purchase of a unit or taking a commercial lease.
What You Will Learn
This course will cover the following:
- How commercial property is different from residential
- Where to go for guidance - websites, books and other resources
- The importance of understanding the physical world , access, easements, fire escapes & your client's objectives
- Reporting to clients on issues and forms of report, making sure the message gets across
- Differences between the commercial conditions and the standard conditions - things to look out for - the PLC standard contract and possible changes VAT etc, commercial aspects of a business sale
- Lender's solicitors where separately represented
- The importance of understanding the land law & that title insurance isn't going to be a solution to all problems
- Searches differences - commercial
- The CPSE suite and why they are important, how to deal with them if acting for a buyer or for a seller - getting the information and warning the client about the dangers of misrepresentation claims
- EPCs CRCs, asbestos, fire safety, flooding
- Planning, use classes, permitted development and why it has to treated more carefully
- Post completion issues mortgages registration and discharges - non-standard lenders priorities
- Property taxes - SDLT, CGT, Capital Allowances
- Commercial leases - an outline of the usual points to watch for, what to warn clients about, the need for proper searches
- Dealings with commercial leases - assignments and subletting
- Security of tenure, its importance and exclusion
