Introduction

With the passing of the Domestic Abuse Act 2021, there has never been a better time to be up-to-date with the law and procedure in relation to domestic abuse.

Prosecuting or defending in such cases always presents a unique challenge - will the witnesses turn up, what will they say, what if they don’t say what we expect them to? And do we need any witnesses at all?

In addition to the evidential issues, this live broadcast session will also look at ancillary issues such as the new definition of ‘domestic abuse’, witness summonses, sentencing guidelines, restraining orders on acquittal and the new domestic abuse protection notices and orders.

What You Will Learn

This live and interactive session will cover the following:

  • Hearsay evidence - admissibility of the 999 call and res gestae generally
  • Previous inconsistent statements
  • The hostile witness
  • Restraining orders on acquittal - Court of Appeal guidance
  • Sentencing guidelines in relation to domestic abuse
  • Digital disclosure - recent guidance from the Court of Appeal on what is covered by the Criminal Procedure & Investigations Act
  • The new Domestic Abuse Act 2021
