Introduction

The purpose of international arbitration is to obtain a final and binding arbitral award that is enforceable across national borders. Clients and lawyers should, therefore, focus throughout an arbitration on the desired end result - obtaining an enforceable award.

The New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards (‘the New York Convention’) provides the foundation for the recognition and enforcement of arbitral awards across national boundaries. More than 170 countries, including the United Kingdom and most significant trading nations, are party to the New York Convention. This virtual classroom seminar will show why it is imperative that - whether it is seeking to an award enforced or resist enforcement - a party is well-aware of the grounds on which recognition and enforcement can be refused and how those grounds have been interpreted and applied by national courts.

This live and interactive course will cover the following:

  • The meaning and purpose of recognition and enforcement of an arbitration award
  • The distinction between resisting recognition and enforcement and seeking to set an arbitral award aside at its seat
  • The procedures and practices for obtaining recognition and/or enforcement of an arbitral award in England and Wales
  • The New York Convention regime including the limited and specific grounds on which recognition and/or enforcement can be refused under the New York Convention and the interpretation and application of those grounds in the English courts
  • Strategy in planning for the recognition and enforcement of an arbitral award, including the need to focus on recognition and enforcement at the outset of an arbitration and how to assist the arbitral tribunal to render an enforceable award
  • Asset tracing and steps that can be taken to identify assets that may be the subject of attempts to seek recognition and enforcement
  • Strategies for coordinating parallel recognition and enforcement proceedings in multiple jurisdictions at the same time
