Introduction
Art market transactions take a variety of forms and styles, ranging from simple sale and purchase agreement between a buyer and seller to chains involving up to ten intermediaries.
Works can be bought at auction, by private treaty, and nowadays agreements are at times concluded as informally as through the simple exchange of emails or messages.
Depending on the context, transactions can quickly be complicated by a third-party ownership claim to a work, damage, loss or theft, and authenticity disputes.
A well-drafted contract and thorough understanding of how to navigate such issues is key to preventing the downfall of a transaction.
