Introduction

Increasing numbers of applications are made to the Court of Protection, yet many practitioners find themselves quickly out of their depth as they attempt to navigate the complexity of the Court Rules and Practice Directions.

This new introductory level full day course includes sample precedents, court forms and case law update, meaning you will leave with the skills to tackle a wide range of Court of Protection applications with confidence.

It is suitable for newly qualified solicitors, those returning after a career break or private client lawyers who need to offer a service to clients in order to meet the demand for Court of Protection applications.

What You Will Learn

The course will cover the following:

  • The court’s extensive jurisdiction and functions of the Office of Public Guardian
  • When to apply to the Court for a welfare or financial decision
  • Drafting skills and the procedure to apply for the appointment of a Deputy
  • How to apply for a Single Order
  • When it is necessary to apply for an order for sale and purchase of property
  • How to identify which type of Trustees' application is needed and make the application
  • When the court will order a gift, settlement and/or statutory will and how to make the application
