Introduction

Regulatory investigations into construction professionals are on the rise. While the number of complaints to the Royal Institute of Chartered Surveyors (RICS), the Royal Institute of British Architects (RIBA) and the Architect's Registration Board (ARB) has remained relatively stable over the past 5 years, the number of ARB complaints which have proceeded to professional conduct committee (PCC) stage has increased 11-fold between 2018 and 2022 from 4 to 44.

This increased activity by the regulators reflects the continued focus on building safety, competency, and equality and diversity in the industry and means that more architects and surveyors will need to grapple with the regulators' disciplinary procedure than ever before. The rules are also changing. The ARB is consulting on a new Architects Code which, if implemented, will be more onerous to comply with. RICS' new rules of conduct are relatively new, having come into force in 2022. The ARB's PCC rules were also revised in 2022 and the RIBA Code in 2021.
