Introduction
Cryptoassets and related litigation is a fast-moving area.
The law in this area is swiftly developing but issues remain uncertain. The legal status of cryptoassets is not well-defined in English law with no legislation in in place, and cryptoassets not being currently regulated by the Financial Conduct Authority.
The English courts have generally been quick to address issues as they arise to ensure that the common law serves litigants.
As a result, there is a growing body of case law of which all litigants need to be aware.
This webinar will provide you with practical tips arising out of these matters.
It will discuss three topical cases:
- Bringing claims against persons unknown since AA v Persons Unknown and Fetch.AI Limited and another v Persons Unknown (categories A, B and C)
- The treatment of cryptoassets by the courts - Tulip Trading Ltd v Van de Laan
- The imposition of constructive trusts in claims involving cryptocurrency exchanges - Piroozzadeh v PU
The webinar will take you through some of the key issues facing practitioners, litigants and cryptocurrency exchanges relating to digital assets, as well as help you to learn about the challenges of this litigation and how the courts are approaching it.
What You Will Learn
