Introduction

Increasingly, financial investigators are alleging the existence of hidden assets and tainted gifts in Confiscation cases. This creates major issues for defendants because they have to prove that these potentially available assets do not exist. Often the hidden assets are alleged because the Prosecution are unable to identify the final destination of monies. This is particularly true when crypto assets are involved.
