Introduction

This webinar will provide a guide to the defences that may be available to common possession proceedings encountered on Court Duty, with references to legislation, case law and CPR provisions.

It will give practical advice on identifying defences that can see a claim struck out at the initial hearing or at least can secure time for a Defence to be filed. It will also deal with matters of the court’s discretion so that you maintain your simultaneous duties to your client and the court throughout your time on court duty.

  • Technical and substantive defences to Section 21 and Section 8 (the rent arrears grounds) possession proceedings
  • Prioritisation of defences in the minutes available on court duty
  • How to structure submissions
