It is important for anyone employing staff in education to be aware of how employment law applies in the education sector.

The terms of conditions for teachers and other school staff are usually governed by collective agreements such as the Burgundy Book. In addition to the contract of employment, terms and conditions for teachers are usually supplemented by the School Teachers’ Pay and Conditions Document (‘STCPD’). Any failure to understand how these terms operate in practice can lead to missed opportunities or schools losing a case in an Employment Tribunal.

There has been some confusion in recent years regarding holiday pay for term-time only workers, which was addressed by legislation earlier in 2024.
