Course Outline
Introduction
This webinar will review the Limitation Act 1980 and consider the circumstances in which the limitation period can be extended taking into account the successor to the NHSR Covid protocol which proposes a fixed period for the extension dependent on whether notice has already been given. Consideration will also be given of key case law including the application of the Supreme Court’s decision in Canada Square Operations Ltd-v-Potter [2023] and Master Cook’s decision in Shaw-v-Maguire (Re Preliminary Issues) 2023.
The webinar will provide practical advice on how to secure extensions of the limitation period and the factors the Court will take into account when deciding whether to exercise discretion in favour of a Claimant under section 33 of the Limitation Act 1980.
