Introduction

Tackling misleading environmental claims remains a key focus for the Competition and Markets Authority (‘CMA’) and Advertising Standards Authority (‘ASA’).

Aside from the reputational risk of getting it wrong, the enforcement risks will increase significantly when the CMA gets new powers to impose penalties of up to 10% of global turnover when the Digital Markets, Competition and Consumers (‘DMCC’) Bill comes into force in mid-late 2024.

As this is an area that is evolving rapidly, any business that makes environmental or sustainability claims is strongly advised to monitor developments closely.
