Introduction

International construction and engineering contracts often include a tiered dispute resolution clause which includes several types of ‘alternative dispute resolution’ (ADR) prior to the ‘last resort’ of international arbitration.

The webinar will provide you with an overview of the types of tiered dispute resolution clauses and ADR commonly used to resolve disputes. It will explain the types and function of dispute boards and, in more detail, FIDIC DABs and DAABs, including their appointment, jurisdiction, procedure, the status of the decision they will issue, and how that decision may be enforced.

It will also include practical and tactical perspectives on how best to handle these pre-arbitral steps.
