Introduction

There is an understanding that the LGBTQ+ community has historically faced additional challenges when it comes to personal relationships and private and family life, and has fought hard for the same benefits enjoyed by heterosexual couples.

Whilst progress has been made, there is still a long way to go, and proper estate planning for LGBTQ+ individuals is crucial to ensure certainty and fairness after they die, in addition to lifetime planning to deal with any tax or capacity issues.

This new virtual classroom seminar will explore the key issues for LGBTQ+ private clients in relation to wills and lasting powers of attorney and in particular what private client practitioners need to be aware of when advising clients.

What You Will Learn

This live and interactive course will cover the following:

  • Issues relating to tax
  • Issues relating to cohabitation and the intestacy rules
  • Gender neutral drafting and gender recognition
  • Children (including IVF and surrogacy) and guardianship
  • Alternative relationship structures (including ethical non-monogamy (‘ENM’) relationships)
  • Potential for Inheritance (Provision for Family and Dependants) Act 1975 claims
  • Core scenarios
  • What an advisor needs to be mindful of when advising LGBTQ+ private clients
  • The key information advisors should ensure clients understand
