Introduction

It is not uncommon for beneficiaries and executors to not see eye to eye when it comes to administering an estate.

Often these issues can be dealt with swiftly and do not require court intervention.

In more pronounced cases where serious misconduct is in view, steps to remove an executor can and probably should be taken.

It is not always clear what steps should be taken to break deadlock and enable the estate to be administered nor is it straightforward what the cost implications are likely to be on the estate and what advice executors are entitled to in these circumstances.
