Introduction

Managing poor performance is a complex issue as there are many different reasons why an employee might be underperforming.

Understanding the reasons is key to determining how to manage the situation, which in turn could result in one of several different approaches including reasonable adjustments, disciplinary action or even dismissal.

Presented by expert speaker Professor Kathy Daniels, this box set is broken down into 6 bite-sized 30-minute sessions and will explore the different avenues available.

Agenda

The modules covered are as follows:

Module 1 - Managing poor performance - practical steps

  • How to raise poor performance issues
  • How to deal with angry and emotional employees
  • Setting and agreeing targets
  • Articulating what ‘good’ looks like

Module 2 - When health (including mental health) is an issue

  • The definition of a disability in the Equality Act 2010
  • Making reasonable adjustments when managing poor performance
  • Specific issues relating to mental health, and managing the stress of a performance discussion
  • Situations in which employment has to be terminated

Module 3 - The law - how to use the disciplinary procedure to manage poor performance

  • Using disciplinary warnings
  • The Acas Code of Practice: Disciplinary and Grievance Procedures
  • Conduct or capability - defining the difference
  • A fair dismissal

Module 4 - Using appraisals and target setting

  • The difference between a performance management and a disciplinary process
  • How to set targets
  • Monitoring performance against targets
  • Different approaches to appraisals, and the most effective ones to use

Module 5 - Avoiding discrimination in managing poor performance

  • Potential for disability discrimination
  • Thinking about age discrimination, for both young and old workers
  • Allegations of discrimination - how they might occur and how to address them
  • Ensuring a fair and reasonable approach

Module 6 - When all the steps do not work, and performance has still not improved

  • When to dismiss. When is it too quick?
  • The use of demotion
  • Protected conversations as a way to manage a termination
  • Settlement agreements
