Introduction
Scam invoices relating to trade mark applications have been an issue for a long time, but the problem has increased over recent years.
The UK Intellectual Property Office has cited a recent surge in the number of misleading or scam invoices and payment requests being received by trade mark holders and IP professionals following the submission of a UK trade mark application.
This is also an issue which is equally relevant to trade mark applications being submitted in the EU or other international territories, with varying scams being seen from territory to territory.
When applying for a registered trade mark on behalf of a client, you should be aware of this issue and the updated guidance issued by the UK Intellectual Property Office and other trade mark registries.
It is also important to ensure that your communications with clients are up to date on this issue and that all staff involved in processing trade mark applications are fully aware of best practice.
