Non-molestation orders are a fundamental way in which the Family Court protects those who are vulnerable. It is an order that can be made in stand-alone proceedings or can coincide with private and public law Children Act proceedings.

This webinar seeks to get back to basics, reminding practitioners on the law and implications of such, and provide practical guidance on how effective non-molestation orders can be.

  • A recap on the law governing non-molestation orders, with specific regard to the Family Law Act 1996
  • The impact of the Domestic Violence, Crime and Victims Act 2004

  • Consideration of whether an application should be made with or without notice
  • Breach of a non-molestation order
  • Consideration of undertakings and when they might be appropriate instead of an order
