Introduction

The Offences Against the Person Act was passed over 150 years ago and has had more than enough time to bed down. However, as society changes, so must the law. The common law has developed the Act to also include potential omissions. It has also developed to deal with the issue of harassment.

This virtual classroom seminar will look at the range of offences which are used to charge offences against the person, specifically assault. Finally, it will look at the Sentencing Guidelines and analyse the level of injury and harm that is required to satisfy the specific categories.

What You Will Learn

This live broadcast will cover the following:

  • Assaults by omission - can a failure to act constitute an assault?
  • Harassment and assault - can an act of harassment potentially constitute an assault?
  • Common assault on an emergency worker - must they be acting in the execution of their duty?
  • Assault occasioning actual bodily harm
  • Inflicting grievous bodily harm/unlawful wounding - section 20 of the Offences against the Person Act 1861
  • Causing grievous bodily harm with intent to do grievous bodily harm/wounding with intent to do grievous bodily harm - section 18 of the Offences against the Person Act 1861
  • Helpful case-law in relation to the Sentencing Guidelines as to what level of injury will be sufficient for the different sentencing categories
