The principles of limited liability and separate legal personality are fundamental to company law, yet much criticised by creditors who lose money when companies fail.
In recent years there has been a focus from the Government to look to crack down on those who abuse their limited liability privileges. But is the law doing enough in this area ? Are directors at risk personally when the company they have been running fails?
