Introduction

Delayed until February 2025, to dovetail with the ‘go live’ date of the Procurement Act 2023 on 24th February 2025, this virtual classroom seminar is presented by a procurement expert. It will cover the Procurement Act 2023 with an analysis and critique of the key changes from current law, the Cabinet Office Web Page Transforming Public Procurement training programme, contents and timetable . The content will be updated as new information is published.

A must for anyone who practises public procurement (lawyers, procurement officers and others in the public or private sectors) with some knowledge of public procurement.

It will address key questions - how far are the changes substantive or more limited than the Cabinet Office say, the new concepts, approach and language of the Act the proposed subordinate legislation, guidance issued by the Cabinet Office and the current Government’s policy for the regime as set out in the updated National Procurement Policy Statement.

What You Will Learn

This live and interactive session will cover the following:

  • What are the objectives of public procurement and will it deliver ‘value for money, economic growth and social value’ (as the Government says)?
  • Whether public procurement will be simpler (again as the Government says)?
  • The conceptual differences in approach, language and the implications
  • Key changes (maximising public benefit, acting with integrity, fair and equal treatment and transparency proportionality complying with government priorities and achieving value for money
  • A greater focus on preliminary market consultation will it change behaviour?
  • Light touch and exclusions
  • Challenge and proceedings from implementation in 2024 and impact
  • Implementation - new regulations, overview of guidance, timetable and programme of learning and development
  • Continuing relevance of existing UK and European case law including future application of European Court of Justice cases to the UK
  • Differences between the law in England Wales and N I and Scotland
  • A very brief overview of the Subsidy Control Act 2023, its regulatory regime, role of the Competition and Markets Authority publication obligations (the Subsidy Data Base) and court challenges
