Introduction

Time is a precious commodity in dispute handling. Sometimes you may need more time than you have. How is that obtained?

What You Will Learn

This virtual classroom seminar will cover two ways in which more time may be ‘bought’:

Standstill Agreements

  • Described by one judge as having an ‘obscure’ popularity, why are standstill agreements ever needed?
  • Approaching opponents
  • Are you asking to extend or to suspend the limitation period?
  • Defining ‘the Dispute’ or ‘the Claim’
  • How are standstill agreements terminated?

Applications to Extend Time to Serve a Claim Form

  • When should claimants apply for more time to serve?
  • The test on which to satisfy the court
  • Showing ‘all reasonable steps’ once the initial time has expired
  • What if the court refuses to extend time?
  • The latest cases involving problems over time in issuing a claim form (Guo v Kinder, Clewer v Higgs & Sons and Walton v Pickerings Solicitors)

In each situation, the latest cases will be mentioned, and a practical illustration will highlight some of the difficulties.
