Terminating Agricultural Tenancies & Land Development

Introduction

This webinar will cover the options for terminating an agricultural tenancy under the Agricultural Holdings Act 1986 where some or all of the land subject to the tenancy is to be developed. This will include service of Case B Notices to quit, an overview of the Tribunal procedure, and payment of compensation. It will also cover the options such as agreeing a surrender, severing the reversion, or relying on Section 31 of the Agricultural Holdings Act 1986.

Some agricultural tenancies can only be terminated in limited circumstances and a strict process has to be followed with timings for service of notices - being aware of these is vital when working in this area to ensure a deadline is not missed, particularly in the context of a wider development transaction.

For those working in development and trying to manage the existence of an agricultural tenancy, they should be mindful of any communications with the farm tenant as these could prejudice their ability to seek possession. Being aware of strategic and tactical considerations in the legal context will reduce this risk, which this webinar intends to cover.
