Introduction

This webinar will cover the approaches which can be taken to terminate a Farm Business Tenancy under the Agricultural Tenancies Act 1995. It will include options such as forfeiture; agreeing a surrender; the exercise of break clauses and service of a notice to quit.

The webinar will also cover the service of notices and practical issues which can arise in this respect, and what happens in the event a tenant refuses to vacate a holding.

This webinar will cover the following:

  • Methods of terminating a farm business tenancy under the Agricultural Tenancies Act 1995, including:
    • Forfeiture for breach of the tenancy
    • Service of Notices to Quit, the tenant’s ability to challenge the notice, and payment of compensation
  • How to rely on part-resumption clauses within the tenancy, or clauses which provided that shorter notice may be given
  • The approach to surrender a tenancy - as an alternative or in addition to one of the formal methods of termination
