Introduction

The Digital Markets, Competition and Consumers Act 2024 (‘the Act’) contains the most important changes to consumer law in a generation.

Amongst other issues, it updates the rules on unfair commercial practices to cover concerns about fake consumer reviews and introduces a new category of ‘subscription contracts.’

However, the most significant change is the introduction of fining powers both for the court and for the Competition and Markets Authority (‘CMA’) directly.

The maximum potential fine will be £300,000 or, if higher, up to 10% of the total value of the Trader’s turnover.

This virtual classroom seminar will explore the key consumer law changes.

    • Repeal of the Consumer Protection from Unfair Trading Regulations 2008
    • How is ‘unfair commercial practice’ defined?
    • What amendments are being made to the schedule of commercial practices which are always considered to be unfair?
  • Subscription contracts:
    • How are ‘subscription contracts’ defined?
    • What pre-contract information must be provided?
    • When should reminder notices be provided and what information should they contain?
    • What cooling off rights are available to consumers?
  • Enforcement provisions:
    • What is meant by ‘relevant infringements’?
    • What changes are being made to the powers of the court?
    • What direct enforcement powers are granted to the CMA?
    • How are monetary penalties calculated?
    • What guidance is available from the CMA about their new powers?
    • When will these powers come into force?
