Introduction

This virtual classroom seminar will examine and explore the Sentencing Act (sometimes referred to as the Sentencing Code).

For many years there has been a belief that there were too many different pieces of legislation about sentencing. The aim of the Code is to bring together all the current legislation into one easily manageable document.

The document consists of 420 sections and 29 schedules. Not something that will be considered in its entirety during this 4-hour session!

The presentation will be of enormous benefit to anyone involved, in whatever capacity, in criminal proceedings but it is particularly aimed at prosecutors, defence lawyers and those responsible for advising the justices in the Magistrates’ Court.

What You Will Learn

This live and interactive session will cover the following:

  • The circumstances in which a sentence may be deferred
  • Committal for sentence of adults (including the committal of dangerous offenders)
  • Committal for sentence of youths (including the committal of dangerous offenders)
  • The various powers available to the Crown Court on a committal for sentence - depending upon which section was used
  • Remission of youths to another Youth Court or to an Adult Court for sentence
  • Pre-sentence reports generally
  • Financial Circumstances Orders and the offences in relation to them
  • The Surcharge
  • The Criminal Courts Charge
  • The role that Sentencing Guidelines play in the sentencing exercise
  • Assessing the seriousness of any offence - aggravating factors and mitigating circumstances
  • Absolute and conditional discharges
  • Referral Orders (children and young people)
  • Reparation Orders (children and young people)
  • Fines (children and young people and adults)
  • Compensation Orders - including restitution and restoration and forfeiture and deprivation
  • Driving disqualifications
  • Youth Rehabilitation Orders and Adult Community Sentences
  • Custodial sentences generally (including Detention and Training Orders) and the suspension of certain custodial sentences
  • Dangerous offenders
  • Mandatory minimum sentences
