Introduction

This virtual classroom seminar will equip you with the knowledge and tactics to recognise when a party is entitled to disclosure and when not, and to exploit / avoid the exploitation from any failures to comply with the law and/or directions. It will also steer you away from abuse of process arguments which are now, as a remedy for non-disclosure, largely dead in the water.

This highly practical course is aimed at anyone who wants to make better use of unused material and is suitable for both prosecution and defence lawyers. Senior Investigating Officers with legal qualifications may also find the course of value. New Guidelines on Disclosure and a new Protocol dealing with Family and Criminal matters come into force in Spring 2024. It is vital to understand them in order to deal with disclosure issues whichever side you act for.

Please note a basic knowledge of CPIA is assumed.

This live session includes real life examples, links to useful materials and plenty of references to statute, case law and the Criminal Procedure Rules.

Also updated to include third party rights to refuse to disclose under the Police, Crime, Sentencing & Courts Act 2022, and changes to the Criminal Procedure Rules and the Criminal Practice Directions 2023.
