Introduction

Drafting trusts and settlements is considered to be a complex and difficult area of law.

Trusts have many uses and are an option for both lifetime planning and in well drafted wills.

Problems can arise however if the trust is not drafted properly, and this has led to cases where the trust is not actually created, the objectives of the trust may not be met, or beneficiaries have lost out.

Trusts are taxed differently from individuals and full advice and careful drafting should be done at the start to ensure the objectives of the trust are being met.
